I understand that the nature of the Scotland Retreat is both social and spiritual in nature and is open to anyone.*

I understand that voluntarily traveling to and attending the Scotland Retreat may involve certain risks beyond the reasonable control of its facilitators, staff, director, and volunteers, in connection with the various Scotland Retreat, including but not limited to accidents, emergencies, exposure to reckless conduct of other persons and/or negligence of, and that The Window Within, LLC and Margie Katzke LLC, et al., disclaim any and all responsibility for any such risks.*

I am in good physical and mental health to attend this retreat.*

I am legally able to travel outside of the United States at the time of this retreat, September 10,2024-September 20, 2024.*

I understand I am responsible for my own self-care and will tend to my own physical and mental health needs during this retreat.*

I understand I will be part of a group during the retreat dates and will be participating in group activities planned by retreat leaders.*

I will be respectful of other retreat participants, and leaders.*

I understand that retreat leaders will do their best to accommodate any food allergies and/or intolerances, and that I am solely responsible for any food I choose to consume during the retreat.*

I will comply with all government health requirements, and COVID-19 protocols.*

I understand that retreat leaders have the right and sole discretion to ask any participant to leave the retreat at any time. If the participant is disruptive to the harmony of the group, and/or violating any of the terms of this agreement. This program and its’ leaders do not discriminate on the basis of race, color, religion, age, sex, sexual orientation, gender identity or expression, national origin, disability, pregnancy, marital or parental status, or any other category protected under the law.*

Medical Permissions (Limited): As a condition of attending the various events, I grant permission in the event of an emergency or accident, for emergency medical care to be administered during or after transportation to a hospital or doctor for emergency medical care. I further understand that it is not the responsibility of The Window Within, LLC and Margie Katzke LLC, Kate Shipp and Margie Katzke to attempt to reach my emergency contacts and that I remain responsible for my medical expenses.*

Retreat leaders do not arrange for the participant’s travel to the retreat destination country, and city location of the retreat. It is the responsibility of the participant to secure airline and additional travel to the retreat destination, and home from the retreat destination endpoint. Retreat leaders will secure all travel for scheduled activities during the duration of the retreat. Retreat leaders bear no responsibility or liability for delays, cancellation of flights, trains, buses or other forms of transportation.

Cancellation policy: All monies paid become non refundable after September 30th, 2023. If there is an emergency need to cancel your registration, you will need to contact Kate or Margie for consideration. If they are able to find someone to take your place, the money will be refunded. If they are unable to secure another attendee by April 30th, 2024, no money will be refunded.*

Retreat leaders will arrange all accommodations for participants during the retreat dates. All accommodations outside of the retreat dates are the participants’ responsibility. Retreat leaders are not liable for any damage to the participants’ room(s). Any financial and legal responsibility for any damages, crimes, or injury will be to the participant responsible for causing.

Retreat leaders require each participant to purchase travel and trip cancellation insurance in advance of the retreat. In particular, due to the inherently risky nature of international travel post global health emergency, COVID-19, retreat leaders require a “Cancel For Any Reason”, provision in there travel insurance policy. It is the participants’ responsibility to ensure that they are adequately insured for the duration of the retreat regarding accident, illness, death, emergency evacuation, repatriation, loss of personal items, cancellation, curtailment, world-wide emergency assistance, and all other contingencies. Participants must email their certificate of coverage for said insurance to Kate Shipp and Margie Sacco Katzke at admin@kateshipp.com by January 31, 2024. Proof of travel insurance is required to secure your spot on the retreat.

Participants acknowledge that international travel can be challenging and bears a higher level of risk pot COVID-19 global health emergency. The risk and uncertainty cannot be eliminated by the retreat leaders, and is part of the experience, enjoyment, and reward of traveling abroad.

In the destination country, standards of accommodation, communication, technology, transportation, access to healthcare, hygiene, safety, and service may be different than standards in the United States. This may require flexibility and patience on the part of the participant. Participants accept these risks. Participants accept all responsibility for their own safety and welfare while traveling to and attending the retreat.

Participants acknowledge that they alone are responsible for their choices, actions, and results during the retreat. Participants accept full responsibility for the consequences of their use or non-use of any information provided by the leadership team during the retreat.

Media Waiver: We consent to the use by The Window Within, LLC and Margie Katzke LLC, Kate Shipp and Margie Katzke any videotape, photograph, slide, audiotape, or any other visual or audio reproduction in which I may appear. I understand that these materials are being used for promotion of various retreats by and for The Window Within, LLC and Margie Katzke LLC, Kate Shipp and Margie . Such promotional activities extend to recruitment, fund-raising, advocacy, etc. I release The from any liability connected with the use of my picture or voice recording as part of any of the above or similar activities.*

Waiver of Liability/Hold Harmless: By signing this liability waiver, I agree and acknowledge that I may be giving up important legal rights and remedies available to myself. For value received, I agree on behalf of myself that I assume all risks and waive any liability of any nature whatsoever against and agree to hold harmless The Window Within, LLC and Margie Katzke LLC, Kate Shipp and Margie Katzke with respect to any and all actions, claims or demands that may be made or brought on our behalf against arising out of or in connection with travel to or attendance at the , or any other activity I may engage in while in transport there. Further, for value received, for any injury to third parties that may arise because of my actions or omissions, I agree to hold harmless and defend The Window Within, LLC and Margie Katzke LLC, Kate Shipp and Margie Katzke with respect to any and all actions, claims, expenses or demands arising there that may be made or brought against The Window Within, LLC and Margie Katzke LLC, Kate Shipp and Margie Katzke , including but not limited to reasonable attorneys’ fees and expenses arising in connection therewith.

I forever discharge responsibility, and hold harmless the retreat leaders, employees, agents, teachers, independent contractors, and other representatives and their heirs, successors, and assigns (released parties) from any liability for any and all claims(as defined immediately below) relating to or caused by the participants’ attendance at and participation in the retreat, and any additional activities or excursions included in the schedule of the retreat.

The term “Claims” shall include any and all liability claims, demands, actions, damages, rights of action, and causes of action of whatever kind of nature that may now or hereafter exist or arise, arising out of personal injuries, losses, suffered, and damages of any kind (including and not limited to direct or indirect consequential, incidental, punitive, or any other damages) including those known and unknown, developed, or undeveloped. Foreseen, and unforeseen, relating to or caused by participant’s participation in the retreat.

I, my heirs, or legal representatives, do hereby waive and release Kate Shipp of The Window Within, LLC and Margie Katzke, LLC from any and all liability and responsibility from injury, accident, illness, legal and medical fees sustained now or in the future resulting from the Scotland Retreat. I acknowledge that I have read this waiver of liability form. I acknowledge that I am signing this agreement voluntarily and intend by my signature to be a complete and unconditional release of liability to the greatest extent allowable by law.
